If you choose to look for injury lawyers you really need to understand why to go to one of them as opposed to your regular attorney.  Most epopel have a family attorney.  This attorney could be the person that does your will, handles most of your estate stuff, they might do your taxes and other things.  This is who you would go to for advice if something suddenly happened.

I always recommend that you go to your family attorney and ask them who you should hire.  Very few family type attorneys will say that they should represent you.  Most of them don’t want to do a personal injury case.  It can be very lucrative for them, but it just isn’t worth all their time.  Usually family attorneys have a much larger clientele that the average injury lawyer.

So what is an injury lawyer and how do they differ from your family attorney?  An injury lawyer is usually a lawyer that is paid on a “commission.”  It’s not really a commission but usually these lawyers get paid a percentage of what they win for you.  This is good for you because no matter how much time it takes for them to win your case they get paid the same.  They also have a big incentive to win your case because otherwise they are working for free.

One thing about this, however, is that it might be hard to find an attorney to take your case.  If you don’t have a case that an injury attorney thinks they can settle they may not take it.  Most injury attorneys don’t want to go to trial.  Think about it, if you were going to get paid a commission and have to do a bunch of work to take something to trial where in essence have a fifty fifty shot of winning, would you rather do that, or settle the case where you get paid a percentage of that settlement?

Most injury lawyers are only looking for cases to settle.  They do take cases to trial they know they can win though.  That gives them a win percentage.  Sort of like a batting average in baseball the better the win percentage the more that attorney can charge you to take your case.  They also then get more clients coming in trying to get them to take their cases because they have a track record of winning.

Basically what I am saying here is an injury lawyer is not going to take a case they don’t think they can win because it hurts the future of their business.  The more they win the more their business grows, so if you don’t have a solid case you are going to need help from your family attorney getting an injury attorney, or you might just end up using your family attorney who doesn’t care so much about his win percentage.
